 Hearings Minimize

1. If the division supervisor denies an appeal, the user may request a hearing. All requests for hearings must be made in writing within thirty (30) days of the decision regarding the appeal. The alarm division will schedule a hearing and send notification of the hearing's date and time to the party requesting the hearing by both certified and regular mail. The hearing will be held by a hearing officer. At the hearing, the appellant and the assistant city attorney may present evidence and make argument.

2. After the hearing the hearing officer will issue a recommended decision to the director of the department. The director will allow either side ten days within which to file any objections to the recommended decision. Alarm users awaiting the results of a hearing will continue to receive emergency service pending the director's final decision.

3. Hearings can be requested each time the division denies an appeal.
