Appeals: Board of Adjustment
Actions of Zoning Administration can be appealed to the Board of Adjustment Zoning as specified in Article II, Division 3 of the Zoning Code. The following can be appealed:
- a denial of a zoning permit application,
- an order "to cease and desist," or
- an action or determination of the Zoning Administrator.
In order to file an appeal, you must first have evidence of the action in writing from Zoning Administration. You should receive a written notice; contact the Zoning Permit Counter if you need a copy of a written decision. All appeals must be filed within fifteen (15) days of the action, unless the Zoning Administrator specifically authorizes an extended filing period.
By filing an appeal, any action of the Zoning Administrator directly related to the appeal is stayed until the hearing.
A denial of a Zoning Use and Construction Permit (Form 21) for construction that does not meet the Zoning Ordinance requirements, must be accompanied by two (2) copies of a scaled site plan, floor plan and elevation drawings. Incomplete submittals will not be accepted for filing for a hearing date.
