What is “discovery?”
Discovery refers to the right of the accused person (defendant) to have access to information the Denver City Attorney’s Office will rely upon to prosecute that person’s case. The rules of discovery entitle a defendant (or defense counsel) to purchase copies of information, facts, documents, and other materials that will be used to prove the case in a court of law. Discovery does not include the work product generated by the Denver City Attorney’s Office, certain records that are available from other agencies to the general public, or documents not in our possession and control.
Who May Request Discovery
Discovery will be provided to the Defendant, the Attorney of Record or an authorized agent ONLY. Discovery will NOT be provided to defendants if they have retained counsel to represent them.

Reactivation fee - you will be assessed a Reactivation Fee of $5 in addition to your original discovery fee because you did not download your eDiscovery packet within 10 business days from the point of time it was prepared and made available to you. All eDiscovery users are notified of the 10 business-day download availability when the eDiscovery request is submitted. In addition, notification of this policy and fee structure is posted on the City Attorney’s website on the eDiscovery page |

How to receive manual discovery
If you are not a victim or witness and you want information from a case, please fill out an Open Records Act request . This request must be mailed, faxed, or hand-delivered. You may or may not be entitled to receive the information you want; if you are not entitled to the information, you will receive an explanation for the denial.
Hours and Location
7:30 a.m.—4:30 p.m., Monday through Friday
If you are requesting paper copies, a CD copy of your discovery packet, or a DVD of audio/video evidence, you may pick it up between the hours listed above, at the Denver City Attorney’s Office Prosecution and Code Enforcement Section located at 201 W. Colfax in the Wellington Webb Building on the 12th floor. Please be advised that this building does not offer any free parking to the public. Metered on-street parking is available, as are several hourly-fee parking lots.
